This Research Report provides an overview of Ireland’s obligations under the Aarhus Convention and EU law in respect of the requirement that certain proceedings are not prohibitively expensive. The OPR engaged Fieldfisher LLP to conduct this overview of the operation of the legal costs system in Ireland in environmental litigation under the Aarhus Convention and EU law.
This Research Report is an addendum to the Legal Costs in Planning and Environmental Judicial Reviews Report – December 2023. It was prepared at the request of the Department of Housing, Local Government and Heritage. The OPR engaged Fieldfisher LLP to conduct a further analysis to support the work of the Inter-Departmental Group on Environmental Legal Costs.
